Terms of Service

Goliath Marketing LLC provides AI-powered business systems, including AI voice agents (inbound and outbound calling), AI chat agents, SMS and email follow-up automations, CRM and internal workflow automations, front-office automation, and the design, build, and hosting of high-conversion websites (collectively, the “Services”).

Services are delivered on a recurring monthly subscription basis. The specific features included depend on the plan you select or the custom scope agreed in writing.

• All plans — including Starter ($297/mo), Growth ($497/mo), Scale ($997/mo), and custom retainers ($1,500+/mo) — are recurring monthly subscriptions.
• Your first payment is charged immediately upon signup. There is no free trial.
• Your subscription automatically renews each month on the same billing date until you cancel.
• Prices are in U.S. dollars and exclude any applicable taxes. We may change plan pricing with at least 30 days' notice; changes apply to future renewals only.
• Payments are processed by Stripe. Goliath Marketing LLC is the merchant of record and the entity that appears on your billing statement.

You may cancel at any time. Cancellation stops all future monthly renewals. Your plan and access remain active through the end of the current paid month, after which service ends. To cancel, email info@goliathgrowthsystems.com or use your account dashboard.

Charges already made are non-refundable. Setup, configuration, and build work begin immediately upon payment, and we do not issue partial refunds for unused portions of a billing month. See the Refund & Cancellation Policy for full details, which is incorporated into these Terms.

You agree not to use the Services to:

• Send unlawful, deceptive, harassing, or unsolicited communications, including calls or messages that violate the TCPA, CAN-SPAM, state telemarketing laws, or carrier rules.
• Contact individuals on do-not-call lists or persons who have revoked consent.
• Impersonate another person or business, or misrepresent the nature of your offer.
• Transmit malware, attempt to breach our systems, reverse engineer our tooling, or resell access without a written white-label agreement.
• Operate in industries or with content prohibited by our telephony, messaging, or AI providers.

We may suspend or terminate Services immediately for violations of this section.

• Provide timely access to accounts, phone numbers, domains, CRMs, calendars, and any other systems required to deliver the Services.
• Provide accurate business content, offers, pricing, and brand assets, and confirm you have rights to use them.
• Obtain and maintain all consents required for your own outreach, including express written consent for calls and text messages where required by law.
• Comply with all laws applicable to your business, industry, telephony, and marketing practices. You are the sender/caller of record for your campaigns.
• Review and approve AI agent scripts, prompts, and automations before launch, and monitor them during operation.

We work to keep the Services available and reliable but do not guarantee uninterrupted or error-free operation. Services may be unavailable due to maintenance, provider outages, telephony or carrier disruptions, AI model degradation, or events outside our reasonable control. We are not liable for downtime caused by third parties.

The Services rely on third-party platforms, which may include Twilio and other telephony/SMS carriers, voice and language model providers (such as ElevenLabs, Vapi, OpenAI, and similar), Stripe, email providers, CRMs, calendars, and hosting providers. Your use of the Services is also subject to those providers' terms and acceptable use policies. We are not responsible for third-party pricing changes, outages, policy changes, or account suspensions.

Any figures, case studies, examples, or projections shown on our website or in proposals are illustrative only and are not a promise or guarantee of results. Business outcomes depend on many factors we do not control, including your offer, market, pricing, staff, follow-up, and lead quality. You accept that you may earn more, less, or nothing at all.

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Goliath Marketing LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

To the maximum extent permitted by law, Goliath Marketing LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility. Our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.

• You own your business content, brand assets, customer data, and your domain name.
• We own and retain all rights to our systems, prompts, agent architectures, automation frameworks, templates, code libraries, and know-how, including improvements made while delivering your Services.
• You receive a non-exclusive, non-transferable license to use our deliverables for your own business for as long as your subscription is active.
• We may reference your business name, logo, and non-confidential results as a portfolio or case-study example unless you ask us in writing not to.

Each party agrees to protect the other's non-public business information and to use it only as needed to perform or receive the Services.

You may terminate by cancelling your subscription. We may suspend or terminate Services for non-payment, chargeback abuse, unlawful use, violation of these Terms, or provider requirements. Upon termination, access to hosted systems, agents, and automations ends, and outstanding amounts become immediately due.

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date, and continued use of the Services after that date constitutes acceptance.

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. The parties agree to attempt good-faith resolution of any dispute by direct negotiation before pursuing formal action. Any action will be brought in the state or federal courts located in Arizona, and each party consents to that jurisdiction and venue.
